Stolen Gold Membership Profile

my profile was stolen by a guy that i played on line with. how can i get it back. i know his gamertag.

You can't and that is why they warn you of giving out info over and over again.  You CAN report it to Xbox Live and they can possibly find a way to ban him but I think you may just have to cut your losses to be honest.
