Problems With A Seller

I recentlypurchased a pair of Aesics shoes from one of your sellers. I brought the shoes with me on a trip and when I went to wear them I found them to be much too big. They were supposed to be a size 6 however they are much much larger than that. I contacted the seller and TOLD HIM THAT I HAD WORN THEM BECAUSE I WAS ON A TRIP AND HAD NO OTHER SHOES. He tole me he would refund my $$ but to wait to send them back to him as he was out of the country. I did as asked, and now he is refusing to refund my $$ as the shoes were worn (I told him that in the first place). And now I come to find out that it is past the e-bay refund date (I had waited AT HIS REQUEST!!). i AM FURIOUS ABOUT THIS! Please help to settle this dispute.
